Aviation shows a real difference between mutual-recognition validation and bilateral workarounds, and AI governance buyers need to know which one they're building.

Two aircraft stories this week look similar and aren’t. Pipistrel’s Velis Electro, a two-seat electric trainer, earned EASA type certification and then picked up validation from the UK Civil Aviation Authority and Transport Canada, plus operating exemptions from the FAA. That is one certificate moving through a network of regulators who have agreed, in advance, to trust each other’s work.

COMAC’s C919 is doing something different. Its recent flight into Mongolia relied on a bilateral airworthiness arrangement in which CAAC is explicitly listed as an acceptable certifying authority for that specific route, one of a small set of countries willing to make that call outside the FAA or EASA umbrella, according to Tech Times. Each new country requires its own negotiated recognition. As one industry expert told SBS, EASA or FAA certification “is not an absolute prerequisite” for market entry, but it remains “one of the most necessary conditions” for competing globally, precisely because it’s the difference between validation and a growing patchwork of one-off deals. This distinction matters far beyond aviation, and it’s the one AI governance buyers should be pressure-testing right now. ISO 42001 certification is issued by accredited bodies operating under their own national or regional accreditation schemes. Neither framework yet has an aviation-style bilateral recognition instrument that lets a certificate issued under one regime travel cleanly into another jurisdiction’s legal requirements. Aviation built that infrastructure over decades, through instruments like the US-EU Bilateral Aviation Safety Agreement. AI governance has not built its equivalent yet, and the absence is easy to miss until a deployment stalls on it.

The practical question for a compliance leader evaluating an AI vendor is not just “is this system certified.” It’s “does that certification travel to the jurisdictions I actually operate in, or am I the one who has to negotiate the equivalent of a Mongolia workaround for every new market.” A vendor that can point to a genuine mutual recognition arrangement, comparable to the UK CAA and Transport Canada validating EASA’s Velis Electro certificate, is offering something structurally different from a vendor whose compliance posture only holds inside one regulator’s borders.

Aviation spent decades building the trust infrastructure that makes validation possible. AI governance is still deciding whether it wants that infrastructure or whether it will settle for a permanent patchwork of bilateral exceptions. Buyers who assume the former already exists are underwriting a risk they haven’t priced.
